Terms of service

1. Scope
The following terms of service apply to all orders placed via our online shop. Our online shop is intended exclusively for consumers.
A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor their independent professional activity.
An entrepreneur is a natural or legal person or a partnership with legal capacity who, when concluding a legal transaction, acts in the exercise of their commercial or independent professional activity.

2. Contractual partners, conclusion of contract, governing law
The purchase agreement is concluded with Manuel Kubica.
By listing the products in the online shop, we are making a binding offer to conclude a contract for these products.
The contract is concluded when you accept the offer for the products contained in the shopping cart by clicking on the order button.
Immediately after submitting your order, you will receive another confirmation via email.

This contract shall be governed by German law, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG). For consumers, mandatory consumer protection laws of their country of residence remain unaffected.

3. Contract language, contract text storage
Language available for the conclusion of the contract: English
We store the contract text and send you the order details and our terms of service in text form. For security reasons, the contract text is no longer accessible via the Internet.

4. Terms of delivery
We ship the products to the delivery address specified during the ordering process. 
We only deliver by mail and it is not possible to pick up the goods yourself.
The delivery time is shown at checkout. Delivery may be delayed beyond estimated times due to customs procedures in certain countries

5. Payment
The goods remain our property until full payment has been made.
The following payment methods are available in our shop.

Credit card
When you place your order, you provide us with your credit card details. Once you have been verified as the legitimate cardholder, the service provider Shopify Payments will carry out the payment transaction.

PayPal
During the ordering process, you will be redirected to the website of the service provider PayPal. To pay via the service provider PayPal, you must be registered with PayPal, authenticate yourself with your credentials, and confirm the payment. The payment transaction will be carried out by PayPal immediately after the order is placed.

Apple Pay
To use Apple Pay, you must be registered with the service provider Apple and Apple Pay must be activated. Authentication of your credentials authorizes payment, and the transaction processes immediately when the order is placed.

Google Pay
To use Google Pay, you must be registered with the service provider Google and Google Pay must be activated. Authentication of your credentials authorizes payment, and the transaction processes immediately when the order is placed.

6. Prices, sales tax, import duty, shipping costs
For orders shipped within the EU, all prices include statutory sales tax.

Orders shipped outside the EU do not include sales tax and may incur additional customs duties, or other taxes imposed by your government. These charges are your responsibility as the buyer.
By purchasing, you agree to pay all applicable duties and fees. If you refuse payment and prevent delivery, you remain liable for the product price, customs charges, and any penalties.

Prices do not include shipping costs, which are shown separately during the ordering process.

7. Warranty and guarantees
7.1 Liability for defects 
The statutory liability for defects applies.

7.2 Warranties 
Information on any additional warranties that may apply and their exact terms and conditions can be found with the respective product.

8. Dispute resolution
We are neither obliged nor willing to participate in consumer arbitration proceedings before a consumer arbitration board.

9. Relationship with Shopify
Mak's Tech Store is powered by Shopify, which enables Manuel Kubica to provide the Services to you. However, any sales and purchases you make in our Store are made directly with Manuel Kubica. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Manuel Kubica, including any injury, damage, or loss resulting from purchased products and services.
You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Manuel Kubica. 

10. Right of Withdrawal
You have the right to withdraw from this contract within fourteen days without giving any reason.
The withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, took possession of the last goods.

To exercise your right of withdrawal, you must inform us (Manuel Kubica, Kastanienallee 38, 71638 Ludwigsburg, Germany, info@makstech.io, phone: +4971414877877) of your decision to withdraw from this contract by means of a clear statement (e.g., a letter sent by post or an email).
You can use the attached sample withdrawal form, but this is not mandatory. 

To comply with the withdrawal period, it is sufficient that you send the notification of your intention to withdraw before the expiry of the withdrawal period.

Consequences of Withdrawal
If you withdraw from this contract, we shall reimburse you for all payments we have received from you, including delivery costs (except of additional costs resulting from your choice of a delivery option other than the cheapest standard delivery offered by us), without delay and at the latest within fourteen days of the day on which we receive notification of your withdrawal from this contract.
We will use the same means of payment for this refund as you used for the original transaction, unless expressly agreed otherwise with you; in no event will you be charged for this refund. We may refuse to refund until we have received the goods back or until you have provided proof that you have returned the goods, whichever is earlier.

You must ship or hand over the goods to us immediately and in any case no later than fourteen days from the date on which you notified us of your withdrawal from this contract.
The deadline is met if you ship the goods before the expiry of the fourteen days.
You shall bear the direct costs of returning the goods.

You are only liable for loss in value of the goods if this loss in value is attributable to handling the goods beyond what is necessary for testing their condition, properties, and functionality.
